ORDINANCES OF THE TOWN OF MT. PLEASANT, NC (1883)

At a meeting of the Board of Commissioners for the Town of Mt. Pleasant, August 11th, 1883, the Town Ordinances were adopted as follows:

No. 1. – DISORDERLY CONDUCT. &C.

BE IT ORDAINED, by the Board of Commissioners for the Town of Mt. Pleasant, That any person who shall be guilty of fighting, assaulting or committing a battery upon any person; or exhibiting himself in a state of intoxication; or whooping, halooing, riotous singing, or swearing, or using any obscene language, singing any blackguard or obscene songs, or be guilty of any indecent conduct or exposure of person, or any of the above acts, within the corporate limits, shall be fined not exceeding Ten Dollars.

No. 2. – FIRE-ARMS AND FIREWORKS.

No person shall fire any kind of fire-arms, or any description of fireworks, within the corporate limits of the town, without the consent of the Mayor.  Any person violating the provisions of this ordinance, shall upon conviction thereof, pay a fine of Fifteen Dollars.

No. 3. – RIDING OR DRIVING RAPIDLY THROUGH THE STREETS

That any person or persons who shall run, ride or drive any horse or horses at a rapid or unusual rate of speed through the streets of the town, shall forfeit and pay a fine not exceeding Five Dollars for each and every offence.  And any person or persons who shall ride or drive any of the sidewalks, or shall hitch any horse to any shade tree, fence, paling or post in any manner as to obstruct said sidewalk (expect in cases of loaded wagons, and Physicians in the charge of their duty by permission of the Mayor,) shall forfeit and pay a fine not exceeding Five Dollars.

No. 4. – PUBLIC WELLS, &C

That any person or persons who shall recklessly or carelessly let down the bucket of the public well in such manner as to injure the bucket or any fixtures of the well or in any manner calculated to injure either of them, upon conviction, shall forfeit and pay a fine not exceeding Five Dollars.

No. 5. – FEEDING STOCK ON THE STREETS

That any person or persons who shall feed any stock attached to a wagon or cart on either of the streets of the town, shall forfeit and pay, for each and every offence, a fine of One Dollar, after being notified of this ordinance.  And any person or persons who shall camp with any wagon or cart in either of the streets, shall forfeit and pay, for each and every offense, a fine not exceeding One Dollar.

No. 6. – STUD HORSES AND JACKS

Any person who shall exhibit a stud horse or jack in the corporate limits of the town, shall pay a fine of Five Dollars; and letting or trying to let a stud horse or jack to any mare or jennie in any exposed place in the corporate limits of the town, shall pay a fine of Five Dollars.

No. 7. – STOCK RUNNING AT LARGE ON THE STREETS

Any person who shall knowingly allow his stock to run at large in the town, shall be deemed guilty of a misdemeanor, and shall pay a fine of One Dollar, for each head of such stock allowed to run at large for each and every offence.

No. 8. – BITCHES

Any person owning a slut, and shall permit the same to run at large within the corporate limits of the town, during the erratic period, shall pay a fine of Ten Dollars for each day she may be permitted to run; and if the owner is unknown the Marshal is required to destroy said slut.

No. 9. – DESTROYING SHADE TREES

Any person who shall wilfully destroy any of the planted shade trees within the corporate limits of the town, shall pay a fine not exceeding Ten Dollars

No. 10. – OBSTRUCTING STREETS AND SIDE-WALKS

Any person obstructing the streets, side-walks and alleys, without the consent of the Mayor, shall pay a fine not exceeding Five Dollars; and for every additional hour he shall permit said obstruction to remain after notice given by the Marshall, shall pay a fine of One Dollar for each hour.

No. 11. – BALL PLAYING OR USING SLING-SHOT

All ball playing or the throwing of ball for practice or sport, in any part of the public streets is hereby forbidden; and any person violating this ordinance without the consent of the Mayor, shall pay a fine not exceeding Twenty five cents for each and every offence. 

No. 12 – PLAYING ON THE WALKS

All games of any kind whatever are hereby forbidden to be played upon the side-walks of the town, and each person engaged in the same shall pay a fine not exceeding One Dollar

No. 13 – DEFECTIVE STOVE PIPES AND CHIMNEYS

Any person who shall keep a defective stovepipe or chimney flue, within the corporate limits of the town, after being notified by the Marshal or Mayor, shall pay a fine of Five Dollars; and Five Dollars for every day same is allowed to remain.

No. 14 – CARCASSES OF DEAD ANIMALS

Any person who shall knowingly allow a dead carcass, or any portion thereof to remain upon his premises, within the limits of the corporation, longer than twenty-four hours, shall pay a fine of Five Dollars; and any person who shall deposit or assist in depositing the carcass of any dead animal or fowl upon any street or alley within the corporate limits of the town, a fine not exceeding Three Dollars.

No. 15 – STAGNANT POOLS AND CELLARS

Any person allowing his cellar to become offensive or stagnant, shall pay a fine of One Dollar for every twenty-four hours said cellar shall remain in such condition after being notified by the town Marshal.

No. 16 – HOG PENS AND PRIVIES

Any person who may hereafter, or who has heretofore erected any hog pen or privy within the corporate limits of the town, and shall suffer the same to become so foul that it becomes offensive in smell, shall pay a fine of Two Dollars for each day it remains in such condition, after being notified by the town Marshal.

No. 17 – EMPTYING OR SWEEPING TRASH INTO THE STREETS

That it shall be unlawful for any person or persons to sweep or empty any store or office sweeping, or trash of any kind, on the pavements or streets or in the street ditches; and any person violating this ordinance shall, upon conviction thereof, be deemed guilty of a misdemeanor, and be liable to pay a fine not exceeding Three Dollars for each and every offence. 

No. 18 – Any person who shall refuse to pay his poll tax, upon demand by the tax collector, shall be deemed guilty of a misdemeanor, and it shall be the duty of the Mayor to issue his warrant for the arrest of such person to work on the streets until at a fair rate of wages, he shall have worked out the full amount of said taxes and costs necessary to enforce this ordinance.

No. 19 – No person shall tie, or in any way attach or assist thereat, a tin can or any other vessel or implement of any dog within the corporate limits of the town; or by using turpentine on dog or dogs; any person violating this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined not exceeding Five Dollars.

No. 20 – RESISTING OFFICERS IN THE DISCHARGE OF THEIR DUTIES

Any person who shall resist the Marshal in the discharge of his duty and any person who shall aid or abet in such resistance, shall pay a fine not exceeding Twenty Dollars, or be imprisoned not exceeding thirty days.

No. 21 – The Mayor shall have discretionary power in reducing or remitting any fine imposed by the Ordinances adopted by the Board.

No. 22 – BLOWING HORNS, BEATING DRUMS &C

Any person who shall blow any horn, beat a drum or with any implement make any unnecessary noise on the streets at any time, shall be guilt of a misdemeanor and upon conviction thereof shall be fined Ten Dollars for each and every offence.  Bands playing in concert or any musical concert is not a violation of this ordinance.

No. 23 – Any person who shall engage in hallooing, singing or making any unnecessary noise at night after business hours, shall be guilty of a misdemeanor and upon conviction shall be fined not less than One Dollar.

No. 24 – TRAMPS AND IDLERS

All tramps and persons without visible means of support lingering about the town, shall be taken up by the authorities, and failing to give satisfactory report of said conduct shall be dealt with accordingly.

No. 25 – PEDDLERS &C

That any person not doing a permanent business in the town of Mt. Pleasant, who shall peddle or set up a shop or tent within the corporate limits of said town for the purpose of selling candies, ice-cream, or any other goods or merchandise, except the products of the farm, shall pay a tax not exceeding five dollars nor less than 25 cents per day to the tax collector.  The Mayor of the town shall have the power to assess the tax in a just proportion to the extent of the business.

No. 26 – PHOTOGRAPHERS &C

That any person whose business it is to take photographs or pictures and who shall set up for such business within the corporate limits of the town, shall pay a tax of fifty cents per month to the tax collector.

No. 27 – All persons within the corporate limits of the town of Mt. Pleasant having gates on the side of walks shall nave the same inside of the lot and all those not opening on the inside, if allowed to stand open, become an obstruction to the sidewalk, and is a violation of ordinance No. 10 and shall be dealt with accordingly.
